Terms of Service

Last updated: November 1, 2026

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of GRM ("the Service"). By creating an account you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. When you create an account you must tick a box to accept them, and we record which version you accepted and when. If you do not agree, do not use the Service.

Pre-release status — invite-only testing, not for public use. The Service is under active development. It is being tested internally and by invited testers only, it is not offered for public use, and no subscription buys production capacity, a service level or a finished product. Because of the sending limit below, the Service cannot deliver the monthly volumes shown on our plan cards, so a subscription is not a sensible purchase at this stage and we do not encourage you to buy one.

Figures shown are target capacity, not current capacity. The contact counts, sequence counts, email volumes and similar figures shown on our marketing pages, pricing page and product demo screens describe the capacity the platform is being built to support. They are not a measurement of what the Service delivers today and they are not a promise of current throughput. The limit stated below is the only volume limit you may rely on.

Current sending limit — 100 emails per day, about 3,000 per month. The email provider behind the Service allows 100 emails per day per account, which is roughly 3,000 emails per month. Every plan is capped at that rate while the provider limit applies, regardless of any larger monthly figure displayed on a plan card. You acknowledge and accept this limit, and the pre-release status above, by accepting these Terms.

2. Who We Are

The Service is operated by Moksh Rawat ("we", "us", "our"), an individual trading as GRM and based in India. Our contact details are in section 20.

3. Description of Service

GRM is an outreach automation platform for businesses. It lets you:

  • store contacts and trigger automated email sequences based on their actions or a schedule;
  • track opens, clicks and replies on the email we send on your behalf;
  • add a website tracking script to your own site so page visits, signups, form submissions and purchases can start or advance a sequence;
  • use our public API and integrations to do the same from your own systems.

The Service is under active development. Features, screens and advertised capacity may change without notice, some advertised capacity is not yet deliverable, and the Service may be interrupted for development work. Do not use it for work you cannot afford to repeat.

SMS sending is not included in any plan and is not currently available. It is described here only so that these Terms already cover it if we enable it later.

4. Accounts, Eligibility and Security

You must be at least 18 years old and able to enter into a binding contract to use the Service. You agree to give accurate account information, to keep your password and API keys confidential, and to tell us promptly if you believe your account has been compromised. You are responsible for everything done through your account, including through API keys you create.

5. Your Obligations

You agree to:

  • comply with all laws that apply to your outreach, including the CAN-SPAM Act and, where your messages reach people in the United States by telephone or text, the Telephone Consumer Protection Act (TCPA);
  • only message people who have given you the consent the law requires, and keep evidence of that consent;
  • keep an accurate physical postal address on file, which we include in every marketing email you send;
  • honour opt-outs promptly and never re-add someone who has asked you to stop;
  • use accurate sender identity and truthful subject lines;
  • disclose your use of tracking to the people it affects, as described in sections 7 and 9;
  • maintain the confidentiality of your account credentials;
  • not use the Service to send spam, illegal content, or harassing messages.

6. Prohibited Uses

You may not use the Service to send unsolicited commercial messages, messages to purchased or rented lists, messages to harvested or scraped addresses, or content that violates any law or regulation. You may not use the Service to impersonate another person or business, to distribute malware, or to attempt to access accounts or data that are not yours. We may suspend or terminate any account or campaign that appears to breach this section.

7. Email Compliance and Sending Limits

We enforce the mechanical parts of CAN-SPAM for you: every marketing email includes an unsubscribe link and an unsubscribe header, we honour opt-outs across your account, and we refuse to send a marketing email if your account has no physical postal address on file. The rest is yours — the accuracy of your headers and subject lines, the identity of the sender, and above all having a lawful basis to email each recipient.

We record opens, clicks and replies on the email we send on your behalf, and we wrap links in a redirect so clicks can be counted. If you are subject to rules that require you to disclose tracking to recipients, that disclosure is your responsibility.

Sending limit. The email provider behind the Service allows 100 emails per day per account, which is about 3,000 emails per month. Every plan is capped at that rate while the provider limit applies, and attempts beyond it will be refused or delayed. Monthly volumes shown on plan cards (for example 5,000, 25,000 or 100,000 emails per month) are capacity targets that the Service is being built to support, not a statement of current deliverable volume. Sending beyond the provider limit would breach provider terms and could result in suspension of the Service for all users.

8. SMS and Telephone Compliance

SMS sending is not currently available on any plan. If and when we enable it, these obligations apply from that point:

  • you must obtain prior express written consent, and keep a record of it, before sending marketing texts to any number;
  • your consent request must identify you and your message programme, and must not make consent a condition of purchase;
  • you must honour opt-outs, including the standard opt-out words STOP, QUIT, END, REVOKE, OPT OUT, CANCEL and UNSUBSCRIBE, and any other reasonable request to stop made in any medium;
  • you must register your brand and campaign for A2P 10DLC messaging where the carriers require it, and keep that registration accurate;
  • you must comply with the legal restrictions on when marketing texts may be sent to a person's local time zone;
  • you must not use the Service to text numbers obtained without consent, or to bypass an opt-out.

9. Website Tracking Script

Some plans include a tracking script that you install on your own website. The script reports events you configure — such as page visits, form submissions, signups and purchases — together with whatever contact details you choose to send, and we store those as contacts and events in your account. Because the script runs on your website and collects information about your visitors, you are responsible for disclosing it in your own privacy notice and for obtaining any consent your visitors' law requires. We do not capture IP addresses, user-agent strings or cookies through the script.

10. Subscriptions, Billing and Payment

Plans are billed monthly in advance at the price shown on our pricing page and confirmed at checkout. New accounts start with a 7-day trial; no payment method is required to begin one, and you are not charged if you cancel before it ends. Subscriptions renew automatically each month until cancelled, and you can cancel at any time from your billing dashboard — you keep access until the end of the period you have already paid for.

Payments are processed by Dodo Payments, which acts as our Merchant of Record. That means Dodo is the seller of record for your subscription, is responsible for charging and remitting the applicable sales taxes, and issues your invoices and receipts. By subscribing, you also agree to Dodo Payments' own terms and privacy policy for the payment part of the transaction.

The pre-release status of the Service and the 100-emails-per-day limit are disclosed on the pricing page, at signup and on the billing page before you can pay. Paying while the Service is pre-release is a decision to support development, not a purchase of deliverable capacity, and it is non-refundable as set out in section 11.

Failure to pay may result in suspension or termination of your account.

11. Refunds

Fees are generally non-refundable, and we do not issue pro-rated refunds for a partial billing period. Two exceptions apply, and they are set out in full in our Refund Policy, which forms part of these Terms: we will credit or refund you for a sustained outage that prevents you using the Service, and we will refund any confirmed billing error. Nothing in this section limits any refund right you may have under mandatory consumer law.

No refund on the basis that actual capacity is below a displayed figure. You accept that the figures on our marketing and pricing pages describe target capacity, not current capacity, and that the current sending limit is 100 emails per day — about 3,000 emails per month. A request for a refund, credit or price reduction whose basis is that the volume, metrics or results you received are lower than a figure displayed on our website, in our demos, or in any marketing material will not be considered and is excluded. The only refund routes are the two exceptions in this section and any right you have that cannot lawfully be excluded.

Payments made while the Service is pre-release. The pre-release status, the 100-emails-per-day limit and the fact that no plan delivers its displayed monthly volume are all disclosed before payment — on the pricing page, at signup and on the billing page. A payment made while the Service is pre-release is therefore not refundable on the basis that the Service is incomplete, under development, invite-only, or unable to deliver a displayed monthly volume. This does not exclude any refund right that cannot lawfully be excluded.

12. Changes to Fees and Plans

We may change our fees or plan limits with at least 30 days' notice. If you do not accept a fee change, you may cancel before it takes effect. We may change or discontinue features, but we will not reduce a limit you have already paid for during the period you have paid for.

13. Intellectual Property

We own the Service, including its software, design and documentation. You get a limited, non-exclusive, non-transferable right to use it while your subscription is active. You keep all rights in your own content — your contacts, templates and campaign copy — and you grant us only the permission we need to store it and to send the messages you have configured. We do not use your contacts or your campaign content for our own marketing.

14. Suspension and Termination

You may cancel your account at any time from your billing dashboard. We may suspend or terminate your account if you breach these Terms, if we are required to by law or by a provider whose service we depend on, or if your sending puts the deliverability of the Service at risk for other customers. Where we can, we will tell you why and give you a chance to fix it first. On termination we delete your data as described in our Privacy Policy.

15. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any message will be delivered, delivered to the inbox, opened or acted upon. Email delivery depends on third parties we do not control.

16. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or exemplary damages, or for lost profits, lost revenue, lost data or loss of goodwill, arising out of or relating to your use of the Service — including deliverability problems, blocked or filtered messages, account suspension, or data loss. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, and nothing affects rights you have under mandatory consumer protection law.

17. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from campaigns you run through the Service — including claims that you messaged someone without the consent the law requires, that your content is unlawful or infringing, or that you failed to disclose your use of tracking. This survives termination. It does not cover claims arising from our own breach of these Terms or our own negligence.

18. Changes to These Terms

We may update these Terms. When we make a material change we will update the date at the top and tell account owners by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, you may cancel, and we will refund any period you have paid for but not used.

19. Governing Law

These terms are governed by the laws of the State of Delaware, United States. If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of your country of residence.

20. Contact

Questions about these Terms, or any notice you need to give us, can go to support@grmhq.com or through our contact page.
